UPDATED: Court acquits Abba Kyari of asset non-declaration charge

The Federal High Court in Abuja has discharged and acquitted suspended Deputy Commissioner of Police, Abba Kyari, and his two brothers in a 23-count charge filed by the National Drug Law Enforcement Agency (NDLEA) over alleged failure to declare assets.

Delivering judgment on Thursday, Justice James Omotosho held that the prosecution failed to provide credible evidence to support the allegations. The judge described the case presented by the NDLEA as “watery,” noting that investigators could not establish any link between Kyari and the disputed properties cited in the charge.

According to the court, the prosecution did not prove that the properties allegedly located in Abuja, Maiduguri, or other parts of Borno State belonged to the suspended police officer.

Justice Omotosho also criticized the inclusion of Kyari’s two brothers in the conspiracy charge, describing it as unsubstantiated and brought in bad faith.

The ruling, however, relates strictly to the allegations concerning asset declaration. Other legal proceedings involving Kyari, including drug-related charges, are still pending in court.
