The National Drug Law Enforcement Agency (NDLEA) has clarified that the substantive drug trafficking case against suspended Deputy Commissioner of Police Abba Kyari remains active and will continue before Justice Emeka Nwite of the Federal High Court in Abuja on Monday, March 16, 2026.
The agency made the clarification following the recent discharge of Kyari by Justice James Omotosho in a separate 23-count charge involving alleged non-declaration of assets.
In a statement, NDLEA’s Director of Media and Advocacy, Femi Babafemi, explained that the ruling delivered by Justice Omotosho relates to a different case bordering on money laundering and asset declaration, and is not connected to the main drug prosecution.
Babafemi said the NDLEA prosecution team would first obtain a Certified True Copy (CTC) of the judgment to study its details before determining its next line of action, including the possibility of filing an appeal.
“First, I need to clarify that the ruling by Justice Omotosho is completely different from the main and substantive drug case, which continues before Justice Emeka Nwite on Monday. That one is very much on course,” Babafemi said.
He reiterated that the NDLEA remains committed to pursuing the drug-related charges against Kyari as the case proceeds in court.
