The Delta State Traffic Management Authority (DESTMA) has issued an official clarification in response to a media publication circulating in the public domain which, it says, misrepresents a judgment of the Delta State High Court, Warri Judicial Division.
In a statement signed by Chris Okinedo, for the Director-General, DESTMA expressed concern over misleading interpretations of the judgment delivered in Suit No. W/348/2016: Chuks Christian Ofili v. The Attorney-General of Delta State & Delta State Traffic Management Authority (DESTMA).
According to the Authority, the judgment specifically addressed the interpretation of Section 18(1) of the Delta State Traffic Management Authority Law, 2013, particularly the issue of administratively imposing fines and penalties without recourse to a court of competent jurisdiction.
DESTMA clarified that the court did not abolish the agency, nor did it invalidate its statutory powers to regulate traffic, enforce traffic laws, arrest traffic offenders, or promote road safety across Delta State.
“The court merely emphasized that the imposition of fines and penalties must be carried out by a court of competent jurisdiction, in line with constitutional provisions and due process,” the statement noted.
The Authority stressed that this position is consistent with the Constitution of the Federal Republic of Nigeria and existing safeguards to protect citizens’ rights.
DESTMA further explained that it currently operates fully within the ambit of the law, noting that traffic offenders are duly charged before competent courts, including properly constituted Mobile Courts, for adjudication, conviction, and the imposition of fines as prescribed by law.
Reaffirming its commitment to legality and professionalism, DESTMA stated that its operations are guided by subsisting court decisions, legal advice from the Office of the Honourable Attorney-General of Delta State, and subsequent legal developments affecting traffic enforcement in the state.
The Authority urged members of the public to disregard misleading narratives and false claims suggesting that DESTMA lacks legal backing or operates outside constitutional limits.
DESTMA concluded by reiterating its unwavering commitment to constitutional compliance, professionalism, and the safety of all road users in Delta State.
